This website is operated by Art of The Gentleman ("Art of The Gentleman," "we," "us," or "our"). We sell men's ties, bow ties, pocket squares, lapel pins, tie bars, suspenders, cufflinks, and curated Gentleman Sets through artofthegent.com (the "Site"). Art of The Gentleman offers this Site, including all information, tools, products, and services available from it, to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our Site and/or purchasing something from us, you engage in our "Service" and agree to be bound by these Terms of Service ("Terms"), including any additional terms, conditions, and policies referenced here or available by hyperlink (including our SMS/RCS Messaging Terms below and our Privacy Policy). These Terms apply to all users of the Site, including browsers, customers, vendors, and contributors of content.

Please read these Terms carefully before using the Site. If you do not agree to all of these Terms, you may not access the Site or use any of our Services.

Any new features or tools added to the store are also subject to these Terms. We may update these Terms at any time by posting changes to this page. Your continued use of the Site after changes are posted constitutes acceptance of those changes.

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, or that you have given us consent to allow a minor dependent to use this Site under your supervision.

You may not use our products or Service for any illegal or unauthorized purpose, and you may not violate any laws in your jurisdiction, including copyright laws. You must not transmit any worms, viruses, or other malicious code. A breach of any of these Terms will result in immediate termination of your access to the Service.

We reserve the right to refuse service to anyone, for any reason, at any time.

Your content (excluding payment card information) may be transferred unencrypted and may involve transmissions over various networks or changes to conform to technical requirements. Payment card information is always encrypted during transfer.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission.

SECTION 3 — ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION

We are not responsible if information on this Site is inaccurate, incomplete, or outdated. Material on the Site is provided for general information only. This Site may contain historical information, which is provided for reference only. We reserve the right to modify Site content at any time without obligation to update it.

SECTION 4 — MODIFICATIONS TO THE SERVICE AND PRICES

Prices for Art of The Gentleman products, including ties, bow ties, pocket squares, and Gentleman Sets, are subject to change without notice. We reserve the right to modify or discontinue the Service, or any product, at any time. We are not liable to you or any third party for any price change, suspension, or discontinuance of the Service.

SECTION 5 — PRODUCTS AND SERVICES

Certain products, including limited-run or seasonal items, may be available exclusively online and in limited quantities. Returns and exchanges are handled according to our Returns & Shipping Policy.

We make every effort to accurately display product colors, patterns, and fabric details, but cannot guarantee that your device's display will be perfectly accurate. We reserve the right to limit sales of any product to any person, region, or jurisdiction, to limit quantities, and to discontinue any product at any time.

Wholesale and bulk orders. Wholesale, bulk, and corporate orders are subject to separate pricing, minimum order quantities, and terms as described on our Wholesale & Bulk Orders page. Standard consumer return and exchange policies may not apply to wholesale or bulk purchases unless otherwise agreed in writing.

SECTION 6 — ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse or cancel any order, including orders that appear to be placed by dealers, resellers, or distributors, or that share billing/shipping details with another flagged order. If we cancel or change an order, we may attempt to notify you using the email, phone number, or billing address provided at checkout.

You agree to provide current, complete, and accurate account and purchase information, and to promptly update it as needed so we can complete transactions and contact you.

SECTION 7 — OPTIONAL TOOLS

We may give you access to third-party tools (for example, size guides, review platforms, or virtual try-on tools) that we neither control nor monitor. Use of these tools is at your own risk, "as is" and "as available," without warranties of any kind from us.

Certain content or links on this Site may direct you to third-party websites not affiliated with Art of The Gentleman. We are not responsible for the content, accuracy, or practices of third-party sites, and we encourage you to review their own terms and policies.

If you send us comments, product reviews, contest entries, or other submissions, you agree that we may edit, copy, publish, distribute, and otherwise use them in any medium without compensation or obligation to you. You are solely responsible for the content and accuracy of anything you submit, and you agree it will not violate any third party's rights or contain unlawful, obscene, or malicious material.

SECTION 10 — PERSONAL INFORMATION

Your submission of personal information through the Site, including for order fulfillment, email marketing, and SMS/RCS messaging, is governed by our Privacy Policy.

SECTION 11 — ERRORS, INACCURACIES, AND OMISSIONS

Occasionally, product descriptions, pricing, shipping charges, or availability listed on the Site may contain errors. We reserve the right to correct any errors and to change, update, or cancel orders based on inaccurate information at any time, even after an order has been submitted.

SECTION 12 — PROHIBITED USES

You may not use the Site or Service: (a) for any unlawful purpose; (b) to solicit others to perform unlawful acts; (c) to violate any regulations or laws; (d) to infringe our intellectual property or that of others, including our Art of The Gentleman name, logo, and product designs; (e) to harass, abuse, or discriminate against anyone; (f) to submit false information; (g) to transmit viruses or malicious code; (h) to collect or track others' personal information; (i) to spam, phish, or scrape the Site; (j) for any obscene purpose; or (k) to interfere with the security of the Service.

SECTION 13 — SMS, MMS & RCS MOBILE MESSAGING PROGRAM

By providing your mobile phone number and opting in through our website, checkout, pop-up, keyword text-in, or other sign-up form, you agree to receive text messages, including SMS, MMS, and RCS (Rich Communication Services) messages, from Art of The Gentleman (the "Messaging Program").

How consent is captured. Consent to the Messaging Program is captured through an unchecked opt-in checkbox or affirmative action at one of the following points: a dedicated sign-up form on our Site, an on-site pop-up, or a checkbox presented during or after checkout. Each of these opt-in points links to these Terms and our Privacy Policy at the point of sign-up, and no box is pre-checked on your behalf. Where required, we log the timestamp, source, and method of your opt-in as proof of consent.

Eligibility. You must be at least 18 years old, or the age of majority in your jurisdiction, and the account holder or authorized user of the mobile number provided, to join the Messaging Program.

Consent disclosure. By opting in, you agree to receive recurring automated promotional and personal marketing text messages (e.g., cart reminders, order and shipping updates, new arrivals, sales, restock alerts, and Dapper Circle rewards offers) from Art of The Gentleman at the mobile number provided. Consent to receive these messages is not a condition of any purchase.

Message types and frequency. Message frequency varies by customer engagement and campaign activity, and may include approximately 2–12 recurring marketing messages per month, in addition to transactional messages related to your orders. Message and data rates may apply.

Supported carriers. The Messaging Program is available on major U.S. mobile carriers, including AT&T, T-Mobile, Verizon, and their affiliated networks. Carrier coverage is not guaranteed, and we are not liable if your carrier does not support the Messaging Program or RCS delivery.

RCS messaging. Some messages may be sent using RCS technology, which can include rich media such as images, product carousels, buttons, and read receipts. If your device or mobile carrier does not support RCS, these messages will automatically be delivered to you as standard SMS or MMS text messages instead. The same consent, opt-out, and rate disclosures in this Section apply equally to SMS, MMS, and RCS messages.

Carrier registration. Our messaging campaigns are registered with mobile carriers in accordance with industry requirements for application-to-person (A2P) messaging, including 10DLC or toll-free number registration, as applicable.

Carrier liability. Carriers are not liable for delayed or undelivered messages. We are not liable for delays or failures in message delivery caused by your carrier, device, or network conditions.

Opt-out. You can opt out of the Messaging Program at any time by replying STOP to any message. After you send STOP, we may send one final message confirming your unsubscription, and you will receive no further messages from that campaign unless you opt in again. You may continue to receive messages for a short period while your request is processed.

Privacy. Your mobile information is used and shared consistent with our Privacy Policy and is never shared with third parties for their own marketing purposes.

SECTION 14 — DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee that use of the Service will be uninterrupted, timely, secure, or error-free, or that results obtained through the Service will be accurate or reliable. The Service and all products delivered through it are provided "as is" and "as available," without warranties of any kind, express or implied.

In no case shall Art of The Gentleman, its directors, officers, employees, affiliates, agents, contractors, or suppliers be liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of the Service or any product purchased through it. Where a jurisdiction does not allow such limitations, our liability is limited to the maximum extent permitted by law.

SECTION 15 — INDEMNIFICATION

You agree to indemnify and hold harmless Art of The Gentleman and its affiliates, officers, directors, agents, and employees from any claim or demand, including reasonable attorneys' fees, arising from your breach of these Terms or violation of any law or third-party right.

If any provision of these Terms is found unlawful or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full effect.

SECTION 17 — TERMINATION

These Terms remain effective unless terminated by you or us. You may terminate at any time by ceasing to use the Site. We may terminate or suspend your access at any time, without notice, if we believe you have violated these Terms.

SECTION 18 — ENTIRE AGREEMENT

These Terms, together with any policies posted on this Site (including our Privacy Policy and SMS/RCS Messaging disclosures above), constitute the entire agreement between you and Art of The Gentleman regarding use of the Service.

SECTION 19 — GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law provisions.

SECTION 20 — CHANGES TO TERMS OF SERVICE

We may update these Terms at any time by posting changes to this page. Your continued use of the Site following any changes constitutes acceptance of those changes.
