Art of The Gentleman ("Art of The Gentleman," "we," "us," or "our") respects your privacy. This Privacy Policy explains what personal information we collect through artofthegent.com (the "Site"), how we use and share it, and the choices and rights available to you. By using the Site or making a purchase, you agree to the practices described in this Policy.
1. INFORMATION WE COLLECT
We may collect the following categories of personal information:
- Identifiers. Name, email address, mailing/shipping address, billing address, phone number, and account login credentials.
- Payment information. Payment card details are collected and processed by our payment processors (see Section 3). We do not store full payment card numbers on our own servers.
- Commercial and transaction information. Products viewed, purchased, or returned; order history; purchase amounts; gift messages; and customer service interactions.
- Communications. Records of emails, chat messages, text messages, and other correspondence between you and us, including customer support inquiries and product reviews.
- Internet and device activity. IP address, browser type, device identifiers, pages viewed, links clicked, referring/exit pages, approximate geolocation derived from IP address, and interactions with our marketing emails and text messages (e.g., opens, clicks).
- Marketing preferences. Your email and SMS/RCS opt-in or opt-out status, and the source and timestamp of that opt-in.
We do not knowingly collect sensitive categories of personal information (such as government ID numbers, precise geolocation, or health information) beyond what is necessary to fulfill and ship your order.
2. SOURCES OF INFORMATION
We collect information: (a) directly from you, when you create an account, place an order, sign up for emails or texts, or contact us; (b) automatically, through cookies and similar tracking technologies as you browse the Site; and (c) from third parties, such as our payment processor, shipping carriers, and marketing/advertising partners.
3. HOW WE USE YOUR INFORMATION
We use personal information to:
- Process, fulfill, and ship orders, and communicate with you about them
- Provide customer support and respond to inquiries
- Send transactional messages (order confirmations, shipping updates, receipts)
- Send marketing emails and text messages (SMS/MMS/RCS) if you have opted in, including promotions, new arrivals, cart reminders, and rewards updates — see our Terms of Service for our full SMS/RCS Messaging Program disclosures
- Personalize your shopping experience and recommend products
- Detect, investigate, and prevent fraud, abuse, and security incidents
- Comply with legal obligations and enforce our Terms of Service
- Analyze Site traffic and improve our products, content, and marketing
4. HOW WE SHARE YOUR INFORMATION
We do not sell or rent your personal information to third parties for money.
We do share certain personal information in the limited circumstances below. Your mobile phone number and SMS/RCS opt-in consent data are never included in any of the sharing described in this Section — including with our advertising and analytics partners — and are never sold, rented, or shared for advertising purposes. See Section 6 for the specific handling of text messaging data.
- Service providers. We share information with vendors who perform services on our behalf, including our e-commerce platform (Shopify), payment processors, email/SMS marketing platform (Klaviyo), shipping and fulfillment carriers, and customer support tools. These providers are contractually restricted from using your information for purposes other than providing services to us.
- Advertising and analytics partners. We may use tracking pixels and similar technologies from advertising and analytics providers, including Meta (Facebook and Instagram), Google, Pinterest, TikTok, and LinkedIn, to measure ad performance and show you relevant ads on those platforms. This sharing is limited to browsing and on-site activity data (such as pages viewed and products browsed) and does not include your phone number or SMS/RCS opt-in data. Under California and other state privacy laws, this type of data sharing for targeted advertising may be considered a "sale" or "share" of personal information, even though no money changes hands. See Section 8 for your opt-out rights.
- Legal and safety. We may disclose information to comply with a law, regulation, subpoena, or court order, or to protect the rights, property, or safety of Art of The Gentleman, our customers, or others.
- Business transfers. If we are involved in a merger, acquisition, financing, or sale of assets, personal information may be transferred as part of that transaction. Mobile opt-in data will only transfer subject to the same consent restrictions described in this Policy. We will notify you of any material change in ownership or use of your information.
5. COOKIES, PIXELS & TRACKING TECHNOLOGIES
We use cookies, pixels, and similar tracking technologies to operate the Site, remember your preferences, measure traffic, and support advertising. These may include first-party cookies (set by us) and third-party cookies (set by analytics and advertising partners).
You can control cookies through your browser settings, including blocking or deleting them; doing so may affect how the Site functions. Where required by law, we will display a cookie consent banner allowing you to accept or reject non-essential cookies. We honor Global Privacy Control (GPC) signals as a valid method of opting out of the sale/sharing of personal information for California residents and residents of other states that recognize GPC.
6. TEXT MESSAGE (SMS/MMS/RCS) DATA
If you opt in to our text messaging program, we collect your mobile phone number and your engagement with our messages (delivery, opens, clicks, replies such as STOP/HELP). This information is used solely to operate the messaging program and is shared only with our SMS/RCS platform provider(s) as necessary to send messages.
We do not sell, rent, or share your mobile phone number or SMS/RCS opt-in consent data with any third party for their own marketing or promotional purposes, under any circumstance. This mobile information is never disclosed to advertising networks, data brokers, or other third parties for their own marketing use. Full messaging program terms, including consent, frequency, and opt-out details, are set out in Section 13 of our Terms of Service.
7. YOUR PRIVACY RIGHTS
Depending on your state of residence, you may have some or all of the following rights regarding your personal information:
- Right to know/access — request the categories and specific pieces of personal information we have collected about you
- Right to delete — request deletion of personal information we hold about you, subject to certain legal exceptions
- Right to correct — request correction of inaccurate personal information
- Right to opt out of sale/sharing and targeted advertising — opt out of the use of your information for cross-context behavioral advertising (see Section 8)
- Right to non-discrimination — you will not receive discriminatory treatment for exercising your privacy rights
These rights are provided under state privacy laws including the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA), and similar laws in states such as Colorado, Connecticut, Virginia, Utah, and others as applicable. If you are located outside the United States, additional rights (such as those under the EU/UK GDPR) may apply to you, including the right to lodge a complaint with your local data protection authority.
To exercise your rights, email us at support@artofthegent.com with the subject line "Privacy Request." We may need to verify your identity before completing your request. You may also designate an authorized agent to submit a request on your behalf.
8. YOUR CHOICES
- Marketing emails. Click "unsubscribe" at the bottom of any marketing email, or contact us at support@artofthegent.com.
- Marketing texts. Reply STOP to any text message to opt out of the messaging program at any time.
- Do Not Sell or Share My Personal Information. To opt out of the sharing of your information for targeted advertising as described in Section 4, email support@artofthegent.com with "Do Not Sell/Share My Info" in the subject line, or enable the Global Privacy Control signal in a supported browser.
- Cookies. Adjust your browser settings or respond to our cookie consent banner to manage non-essential cookies.
9. DATA RETENTION
We retain personal information for as long as necessary to fulfill the purposes described in this Policy, including to process orders, comply with tax and accounting obligations, resolve disputes, and enforce our agreements. Retention periods vary depending on the type of information and legal requirements that apply to it.
10. DATA SECURITY
We use commercially reasonable administrative, technical, and physical safeguards to protect personal information, including encrypted transmission of payment data and restricted access to customer information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
11. CHILDREN'S PRIVACY
Our Site and Services are intended for individuals who are at least 18 years old, or the age of majority in their jurisdiction. We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13 without verified parental consent, we will delete that information promptly. Parents who believe their child has provided us with personal information may contact us at support@artofthegent.com.
12. INTERNATIONAL USERS
Art of The Gentleman is based in the United States, and information we collect is processed and stored in the United States. If you access the Site from outside the United States, your information will be transferred to, stored, and processed in the United States, where privacy laws may differ from those in your jurisdiction.
13. THIRD-PARTY LINKS
Our Site may contain links to third-party websites that are not operated by us. We are not responsible for the privacy practices of those third parties, and we encourage you to review their privacy policies before providing them with personal information.
14. CHANGES TO THIS PRIVACY POLICY
We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. We will post the updated Policy on this page with a revised "Last updated" date. Material changes will be communicated through a notice on our Site or by email where appropriate. Your continued use of the Site after changes are posted constitutes acceptance of the updated Policy.
